CIB welcomes High Court decision

The cross-party Campaign for an Independent Britain (CIB) is bracing itself for a major fight with Gordon Brown's Government over the Treaty of Lisbon - the revived EU Constitution - following the decision in the High Court today (May 2) to allow a landmark legal challenge to the Government by businessman Stuart Wheeler.
 
Mr Wheeler, supported by CIB and other pro-democracy groups, including the Freedom Association, has today been granted permission by Mr Justice Owen in the High Court to seek a Judicial Review of the refusal by Prime Minister Gordon Brown and Foreign Secretary David Milliband to allow a referendum on the Treaty of Lisbon (the revived EU Constitution).
 
Explaining the reasons for mounting this legal challenge to the Government, Mr Wheeler said that the Labour Party, as well as the other two main parties, had made an unambiguous promise that they would hold a referendum, and they should keep that promise. The Treaty, he said, was immensely important and the British people should be allowed a say on whether or not it was ratified.
 
"The Lisbon Treaty has far-reaching consequences for British democracy," said CIB spokesman Andy Smith. "Gordon Brown and David Milliband wish to deprive the British people of our right to have a say on this Treaty, which is simply the discredited EU Constitution under another name. They are attempting to impose EU rule by the back door. Stuart Wheeler has taken this issue to the High Court and he was won the first round. The High Court has ruled that we have a case, and the Government must answer. Now we must brace ourselves for the legal battle ahead."

CIB Chairman joins UK Independence Party

Campaign for an Independent Britain (CIB) Chairman Dr Bob Spink MP has joined the UK Independence Party (UKIP). Dr Spink, MP for Castle Point, Essex, becomes UKIP’s first member in the House of Commons. He previously sat as a Conservative.
 
CIB has led parliamentary opposition to the European Union for over 30 years and draws its support across the political spectrum. It is entirely independent and provides a voice for Eurosceptics in all parties. The CIB committee includes MPs from both sides of the House of Commons, as well as leading activists from grass-roots campaigning groups and the trade union movement.
 
In addition to his chairmanship of CIB, Dr Spink has been active in the ‘Better Off Out’ group, and was chairman of the Pro-Referendum Rally calling for a referendum on the EU Constitution as promised by the Conservatives, Labour and Liberal Democrats in their manifestos.

Campaigners rally behind High Court challenge

The cross-party Campaign for an Independent Britain believes that the Government’s refusal to hold a referendum on the Treaty of Lisbon – the revised EU Constitution – is profoundly undemocratic and a breach of faith with the electorate, in light of the election manifesto commitment made by the Labour Party (and all the other major parties) in 2005.
 
On Tuesday 22 April the High Court in London will hear an application by businessman Stuart Wheeler for a judicial review of the Government’s decision to refuse a referendum. Mr Wheeler’s case is that the Government’s failure to honour its manifesto commitment is unlawful and in breach of a “legitimate expectation” that a referendum would be held, the Labour Party having made an “unequivocal promise to put the Treaty to the British people in a referendum”. The defendants in the case are the Prime Minister, Gordon Brown, and his Foreign Secretary, David Milliband.
 
The High Court challenge is supported by a broad coalition of pro-democracy organisations.
 
Andy Smith of the Campaign for an Independent Britain said: “We are calling on all those who care about British sovereignty, freedom and democracy to support Stuart Wheeler’s challenge to the Government over the Treaty of Lisbon. The British people are being denied the right to have a say on a Treaty that has far-reaching implications for the future of the United Kingdom. Stuart Wheeler is to be congratulated for having the courage of his convictions and we hope that he succeeds in his application for a judicial review, which may well prove our last chance to stop this iniquitous Lisbon Treaty.”
 
Simon Richards of The Freedom Association added: “The British people, denied the referendum we were promised by the Labour Party at the last general election, owe Stuart Wheeler an immense debt of gratitude for challenging the Government in the courts on this critically important constitutional issue.”
 
John Gouriet of Defenders of the Realm said: “I would encourage everyone who values liberty to support our case, heroically fronted by Stuart Wheeler. It is rapidly becoming hugely expensive and every effort must be made to offset the costs, but the issue is so vital we must not and will not be deterred. Please come along to the High Court in the Strand on 22 April to show your support. Hopefully public opinion will win the day against arrogant and duplicitous politicians who have abused their authority in the surrender of our nation to the EU.”

Britain would be better off out - but politicians are lying to us

Britain would have a much brighter future outside the European Union, Eurosceptics have already won most of the arguments about the EU but have so far been unable to de-rail the “European project” because too many politicians have a vested interest in keeping the EU on track.
 
Daniel Hannan MEP (Conservative MEP for South-East England), speaking at the annual conference of the Campaign for an Independent Britain (CIB), said that CIB had been “right all along” and should take heart in having “comprehensively won the argument” about UK membership of the EU.
 
“On one level we have been enormously successful,” Hannan told a packed meeting at the Emmanuel Centre in Westminster. “Nobody in the UK now thinks we should have a single European currency, a common system of justice, a common defence policy or a common foreign policy. But somehow, despite public opinion having turned decisively against the EU, the European project continues uninterrupted. The politicians are too wedded to staying in the EU at all costs. Our democracy has been subverted to the point where a political party is unable to deliver on a key election pledge because that would mean abandoning the principle of EU membership.”
 
As recent House of Commons debates on the Lisbon Treaty/EU Constitution had shown, Prime Minister Gordon Brown and Liberal Democrat leader Nick Clegg both had to deceive the British Parliament and people “because that is what is required in order to keep the European project on course”. Hannan added that the EU’s hold on politicians was so strong that Bertie Ahern had resigned as Irish premier so that the forthcoming Irish referendum on the Lisbon Treaty would not become “a referendum on sleaze”.  
 
Gerard Batten MEP (UK Independence Party MEP for London) said that British membership of the EU had been promoted through “misrepresentation, deceit and outright lies”. Batten, who is also UKIP’s candidate for London Mayor, said that mass immigration into Britain, the result of the EU’s policy of free movement of labour, had been proved to have “no economic benefits” and was severely overloading the UK’s public services. “But uncontrolled immigration has a very specific purpose,” he told the meeting, “and that is to destroy our national identity. That’s why the EU promotes immigration.”
 
Batten explained how much Britain’s membership of the EU was costing British taxpayers – over £50 billion per annum (or £5.7 million every hour) – and said that it was clear we would be “better off out”. Our EU membership was defended on the grounds that it promoted trade, but in reality, said Batten, the UK had accumulated a staggering £359 billion trade deficit with the EU, with many European countries becoming dependent on their trade with Britain. “There are no risks to us if we leave, as they need us more than we need them. And if we came out, the money we’re currently wasting on Europe could instead be spent in Britain for the benefit of British people.”
 
Neil Herron (Metric Martyr Defence Fund) said that despite recent comments to the contrary by the European Commission Vice-President it was actually “still a criminal offence to defy Europe by selling goods in imperial measurements. This ban is a violation of our human rights.” The Metric Martyr Defence Fund, with the support of CIB, was actively fighting the ban, he said. The case brought by Hackney Council against Janet Devers would shortly come to court. “It’s set for a jury trial,” Herron told the CIB conference, “and we’re delighted. Where in this country are they going to find a jury who’ll convict a 63-year-old East End pensioner simply for selling fruit & veg by the pound?”
 
He urged CIB supporters to “fight hard against the EU all the way, because in the end we’ll win. We must fight all the little battles as they come along because that way we’ll win the war. We have to draw a line in the sand and say ‘No’ to the EU.”
 
Dr Bob Spink MP (Independent Conservative MP for Castle Point, Essex), CIB Chairman, said that according to recent polls the majority of Britons now favoured loosening the UK’s ties with the EU. “We need to re-negotiate our relationship with Europe. That’s the majority view.” He added that the Common Fisheries Policy was “the single most powerful reason for leaving the EU. We are a maritime nation, an island nation, but we have lost control of the waters around our coast. It’s ridiculous that under the Common Fisheries Policy more fish are thrown back dead or landed illegally than are landed legally.”
 
Dr Spink also attacked the “widespread fraud and corruption” in the European Union, and cited the refusal of the EU’s own Court of Auditors to sign the EU accounts because of discrepancies. “If the European Commissioners were directors of a company they’d be in prison by now. What these people are doing is taking money from British taxpayers, from British pensioners, and from British public services. It’s a scandal. All of us would be better off out of the EU.”

Campaigners look forward to brighter future without the EU

Britain would have a much brighter future outside the European Union, according to speakers at the annual conference of the Campaign for an Independent Britain (CIB) taking place in Westminster today (April 5).
 
With Gordon Brown’s Government still refusing to honour its election pledge to hold a referendum on the EU Constitution, leading Eurosceptic campaigners including Daniel Hannan MEP (Conservative MEP for South-East England), Gerard Batten MEP (UK Independence Party MEP for London, and candidate for London Mayor), Dr Bob Spink MP (Independent Conservative MP for Castle Point, Essex) and Neil Herron (Metric Martyr Defence Fund) will map out an alternative vision for a free, independent, democratic Britain.
 
Under the Eurosceptics’ plans Britain would be free to trade and cooperate with countries throughout Europe and the wider world; we would be liberated from the heavy burden of EU regulations and the disastrous Common Agricultural Policy and Common Fisheries Policy; and we would save billions of pounds every year by not having to subsidize the European Commission, the European Parliament and other EU institutions. We would also have the opportunity to rebuild our national institutions, strengthen our liberties and make Britain more genuinely democratic than ever before.
 
The Government’s determination to impose the Lisbon Treaty/EU Constitution on this country at all costs, and its refusal to allow the British people to have their say on the Treaty, could be ‘a bridge too far’ for Gordon Brown and his ministers, the CIB conference will hear. Such a flagrant disregard for democracy will trigger a ‘sea change’ in opinions towards Europe, leading eventually to Britain’s withdrawal from the bureaucratic, undemocratic, corrupt European Union.

'People Power' can stop the Lisbon Treaty

British Eurosceptics are not alone in their opposition to the Lisbon Treaty/EU Constitution, and there is a real chance that ‘people power’ across Europe could yet prevent the Treaty’s implementation. That is the message from the cross-party Campaign for an Independent Britain (CIB), whose members gather for their annual conference in Westminster this weekend. CIB has consistently opposed moves by the European Union to extend its powers and sees the Lisbon Treaty as the biggest step so far towards creation of a single European state.
 
In recent weeks hundreds of thousands of Europeans have taken part in pro-democracy rallies and protests across the continent, from Vienna – the site of two major demonstrations by Austrian anti-EU campaigners – to Lisbon itself, where 200,000 Portuguese trade unionists took to the streets recently to voice their opposition to the Treaty. These opponents of the Treaty are united in their determination to defend their liberties, which they see as under threat by the latest Brussels ‘power-grab’.
 
CIB spokesman Andy Smith said: “Strong, independent nations are the one sure defence against tyranny. So far the EU has accumulated power in Brussels slowly and stealthily, with a series of treaties brought in by the back door. But the Lisbon Treaty, in one fell swoop, dramatically accelerates the destruction of national independence and the concentration of power in the European Commission, with only the toothless European ‘Parliament’, a glorified talking-shop, offering any kind of check or balance – and all of this at taxpayers’ expense.
 
“By refusing to hold a referendum on the Lisbon Treaty, Gordon Brown, Nicolas Sarkozy and Angela Merkel have shown that they do not want the people of Britain, France or Germany, let alone the smaller nations, to be given any say in the future direction of Europe. The leaders are determined to close down democratic debate. They must not be allowed to succeed. British anti-EU campaigners must join forces with those throughout Europe who oppose the Lisbon Treaty/EU Constitution and all it stands for.”
 
The CIB annual conference, at the Emmanuel Centre, Westminster, on Saturday April 5, will help point the direction for the next stage of anti-EU campaigning in Britain, and will address the need for pan-European and cross-party unity against the power-grabbing EU. The conference will feature major speeches by Daniel Hannan MEP (Conservative), Gerard Batten MEP (UK Independence Party – Candidate for London Mayor), Neil Herron (Metric Martyr Defence Fund) and CIB Chairman Dr Bob Spink MP (Independent Conservative).

Left and right unite for major Eurosceptic conference

Eurosceptic politicians and campaigners from across the political spectrum join forces next month for a major conference examining ‘the way forward’ for Britain’s fast-growing anti-EU movement.
 
As the battle over the Lisbon Treaty moves from the House of Commons to the House of Lords, the cross-party Campaign for an Independent Britain (CIB) holds its annual conference in Westminster on Saturday 5th April, to plan future strategy and coordinate grass-roots action.
 
The meeting, which takes place at the Emmanuel Centre close to the Houses of Parliament, will address not only the problem of the Lisbon Treaty, but also other aspects of ‘the European project’ such as the hidden costs of the EU and the true extent of Brussels’ influence on British politics.
 
Among the speakers lined up for this major Eurosceptic event are:
 
Daniel Hannan MEP (Conservative MEP for South-East England);
Gerard Batten MEP (UK Independence Party MEP for London, and UKIP candidate for Mayor of London);
Dr Bob Spink MP (Independent Conservative MP for Castle Point, Essex);

The conference will comprise two sessions – the morning is the annual general meeting of CIB, and the afternoon is the public session, to which all are welcome.

Campaigners condemn Government's hypocricy over Oath

With the Government considering the proposal by the Goldsmith review of citizenship to introduce an oath of allegiance for young British citizens, the cross-party Campaign for an Independent Britain (CIB) is calling for Members of Parliament to remember their own oath of allegiance and their duty to defend the British Constitution.
 
All MPs swear to “be faithful and bear true allegiance to Her Majesty Queen Elizabeth, her heirs and successors according to law.”  CIB believes that MPs who voted for the European Union (Amendment) Bill – the legislation putting the Lisbon Treaty (the resurrected EU Constitution) into effect in the United Kingdom – are in breach of their higher duty to Britain and the Monarchy.
 
The Lisbon Treaty makes the European Union a single legal entity for the first time, with its own Head of State (a full-time EU President) and Foreign Minister (“High Representative”) heading an EU diplomatic service. Gordon Brown’s Government, aided by the Liberal Democrats, has pushed the European Union (Amendment) Bill through the House of Commons on a three-line whip, defeating a ‘rainbow coalition’ of Conservatives, Unionists, Nationalists, Independents, and a small number of Labour and Liberal Democrat ‘rebels’. Amendments to the Bill, requiring a referendum on the Treaty, and a motion seeking to ensure that “nothing in this Act shall affect or be construed by any court in the United Kingdom as affecting the supremacy of the United Kingdom Parliament”, were all heavily defeated by the Labour majority in the Commons.
 
CIB spokesman Andy Smith commented: “Even the Polish Prime Minister is threatening not to approve the Lisbon Treaty unless the ratification Bill contains legal guarantees respecting Poland’s sovereignty and Constitution as the highest law in that country. So, how is it that a majority of members of the House of Commons can in all conscience, and in flagrant violation of their oath of allegiance as MPs, vote to inflict the EU Constitution on the British nation without providing any legal safeguards against the growth of EU power or even offering the British people a chance to have their say in a referendum? The Labour Government, and the LibDems who supported them, have let down the people of Britain and neglected their duty to protect the nation’s sovereignty. For the Government to seriously consider asking young Britons to swear a loyalty oath when so many members of the House of Commons cannot even remain true to their own oath of allegiance is the height of hypocrisy – and, more than that, an insult to the British people.”

Labour and Liberal Democrat MPs urged to defy whip over EU treaty

Most Labour and Liberal Democrat Members of Parliament realise that the Lisbon Treaty – the European Union’s so-called ‘Reform Treaty’ – is virtually identical to the discredited EU Constitution, and that it will have far-reaching implications for British democracy, but are too timid to say so. Frightened of defying their party whips, these MPs are hoping that the forthcoming Irish referendum will scupper the Treaty and relieve them of the burden of having to resist the Treaty themselves.

This is the view of the cross-party Campaign for an Independent Britain (CIB) based on research that it has undertaken among backbench Labour and LibDem MPs, House of Commons staff, and party activists. The CIB says that the attitude of these MPs is “unrealistic and dangerous”, as it puts the future of British parliamentary democracy and sovereignty in the hands of another country’s voters. “It seems from our research that many Labour and LibDem MPs are putting their faith in the Irish electorate to do their job for them”, said a CIB spokesman.

On the eve of the House of Commons vote on whether or not to hold a referendum in Britain on the Lisbon Treaty, CIB’s Andy Smith said: “Labour and LibDem MPs are playing with fire. Many of them understand the true nature of the Treaty and the danger that it presents to our democratic system, and they agree with us that the issue is so important that it should be put in front of the British electorate in a referendum. But these MPs are unwilling to defy the party whips by saying so in public, let alone by voting against the Government and LibDem leadership on this issue. They prefer to put their trust in the outcome of the referendum across the Irish Sea. This is an extremely risky policy as the Irish vote could go either way. CIB urges eurosceptic Labour and LibDem MPs to follow their conscience and vote with the Conservatives on this one critically-important issue. You know it’s the right thing to do.”

MPs will vote tomorrow (March 5) on the amendment proposed by Shadow Foreign Secretary William Hague to Clause 8 of the European Union (Amendment) Bill, the legislation which gives legal force to the Lisbon Treaty in the UK. The aim of Mr Hague’s amendment is to ensure that the Treaty legislation is not given Royal Assent without first being subject to a referendum of the entire British electorate.

Liberal Democrat leader challenged on referendum pledge

Liberal Democrat leader Nick Clegg is under pressure from the cross-party Campaign for an Independent Britain (CIB), to make good his promise of a referendum on the European Union.

The Liberal Democrats have failed this week in their attempt to introduce an amendment to legislation on the Lisbon Treaty currently before the House of Commons, to provide for a referendum on the wider issue of Britain’s EU membership. Their proposal was ruled out today by the Deputy Speaker, prompting Liberal Democrat MPs to walk out of the Commons in protest.

CIB argues that the Liberal Democrats should instead align themselves with the Conservatives, Unionists, SNP and Plaid Cymru in pushing for a national vote on the Lisbon Treaty because of its far-reaching constitutional implications. CIB, which has support from across the political spectrum, believes that the Treaty is by far the most significant issue facing Parliament, as its implementation will mean significant transfers of powers from Britain to the EU. The Liberal Democrats are divided on the issue of whether or not to press for a referendum on the Treaty. A coalition of pro-democracy groups including CIB will tomorrow stage a mass lobby of Parliament calling for a referendum.

CIB spokesman Andy Smith said: “Nick Clegg is in a very difficult position now. He has argued forcefully that the British people should have the right to vote on Britain’s relationship with the EU, as we have not had such an opportunity to vote since 1975, when Europe was a very different beast indeed. The Common Market, as it was then, has in the intervening years become the highly centralised European Union that now accounts for 80% of our laws. But if it is right to give voters a say on British membership of the EU, as Mr Clegg believes, there is surely an even stronger and more immediate case for a referendum on the Lisbon Treaty, as the Treaty’s purpose is to move the EU to the next stage and to greatly increase Brussels’ powers over the UK. This is the most significant issue in British politics today.

“If they truly value British democracy, the Liberal Democrats should stand shoulder to shoulder with the Conservatives, Unionists, SNP, Plaid Cymru, and a growing number of backbench Labour MPs, in demanding a national referendum on the Lisbon Treaty.”

Tory MP right to brand EU 'fraudulent and corrupt'

Philip Davies MP (Conservative – Shipley) is right to describe the European Union as “fraudulent and corrupt” and to call for the United Kingdom to withhold further payments to Brussels unless and until the EU receives a clean bill of health from its auditors.
 
The cross-party Campaign for an Independent Britain (CIB) applauds Mr Davies for speaking the truth about the EU during the House of Commons debate this evening on the European Communities (Finance) Bill. CIB also praises Conservative MPs Bernard Jenkin and Peter Bone, and Labour MP Ian Davidson, for their tough questioning of Andy Burnham MP, Chief Secretary to the Treasury.
 
CIB spokesman Andy Smith comments: “This is the thirteenth year that the European Union’s auditors have refused to sign off the EU’s accounts owing to ‘[persistent] errors of legality and regularity’ and ‘weaknesses in internal control’. Britain’s current contributions to the EU budget amount to some £14bn a year. The present Government has given up a substantial part of the UK’s rebate and has consistently failed to stand up for the UK taxpayer. Philip Davies was absolutely right to highlight this appalling state of affairs. Ministers should take Mr Davies’s advice and say to Brussels: ‘Enough is enough!’”

Government is imposing EU Constitution 'by the back door'

The Government must provide sufficient information in advance to allow a proper debate on the European Union (Amendment) Bill and its implications for British parliamentary democracy. This is the demand from the cross-party Campaign for an Independent Britain (CIB), whose chairman Dr Bob Spink MP has tabled two Early Day Motions aiming to secure the right of MPs of all parties to have sufficient time to study the Bill, which is due for its Second Reading in the House of Commons next Monday (21 January).
 
CIB insists that in view of the Bill’s constitutional significance, the Government must ensure that all MPs have access to full information in advance of the Second Reading, and that during the debate itself sufficient time must be made available for contributions from backbenchers on both sides of the House, rather than letting Ministers and front-bench spokesmen monopolize the discussion. Dr Spink commented: “As with the Treaty of Lisbon itself, which this Bill seeks to impose on us, Members of Parliament are not being given sufficient time to debate something that will have enormous consequences for the future of British democracy. The Government clearly intends to push this Bill through without allowing MPs the opportunity to examine or discuss it properly.

That this House notes that the second reading of the European Union (Amendment) Bill is set down for 21st January 2008; asks the Government to make available forthwith an analysis of the full text of the relevant Treaty, including its protocols, declarations and similar material; urges the Government to publish immediately an explanatory memorandum setting out any provisions of the Treaty which are additional to existing provisions of European Community or Union Treaties currently in force, or which place further obligations on the Crown, courts and Parliament of the United Kingdom; further asks the Government to set out whether the currently stated objective of the European Union, of ever closer union will be reflected in either the Bill or the Treaty in any way whatsoever; and further urges the Government to set out whether there will be any change, as a result of the Treaty, to the provisions of the European Communities Act 1972 Clause 2 (1) relating to the powers of Crown or Parliament.

 
“The European Union has a short timetable for forcing its renamed EU Constitution on us, as it hopes to avoid the kind of inconvenient referendums which torpedoed the draft Constitution last time.
